Walmart Agrees to Update Check Processing Disclosures
Walmart has agreed to settle a class action lawsuit alleging it failed to adequately disclose how returned checks were processed through TeleCheck. According to the lawsuit, customers were not clearly informed that multiple collection attempts on a returned check could result in multiple bank fees. While Walmart denies any wrongdoing, it agreed to implement changes to its check-processing disclosures nationwide to resolve the litigation.
Unlike many class action settlements, this agreement focuses on changing business practices rather than providing cash payments to consumers. Under the settlement, Walmart will update its in-store check policy and PIN pad disclosures to clearly explain that if a check is returned unpaid, Walmart and TeleCheck may attempt to collect the payment multiple times, and each attempt could trigger separate bank fees. The goal is to give consumers clearer information before they choose to pay by check.
